Thursday, June 9th, 2011Two former managers at Zachry Industrial who entered into plea agreements for their roles in a scheme to defraud the company were sentenced Friday, but a third failed to show up.
U.S. District Judge Fred Biery sentenced Jason Bardin, 37, to four years in a federal penitentiary and $3.5 million in restitution for conspiracy to commit mail fraud. John Tidwell, 54, of Hobe Park, Fla., must pay $177,100 in restitution and serve one year and one day in federal prison.
Former Zachry employee Kenneth Willson of Houston failed to appear for sentencing. His attorney, Michael Stone, said he had been in touch with Willson in recent days and had no idea why he wasn’t there. Biery issued a warrant for Willson’s arrest.
Five of the eight people charged in the case have pleaded guilty. The indictment alleges that David J. Reitman and Gary Schwing, both of Houston, received almost $11 million from five Zachry employees between 2003 and 2010 in exchange for kickbacks.
